By accessing or using Ergon Chat ("Service", "Platform", "we", "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Ergon Chat is a career preparation platform that provides: • **Resume generation and customization** using artificial intelligence • **Job application tracking** (Job Tracker) • **Interview simulation** with AI-generated feedback • **Gap analysis** to identify skill gaps between your profile and job requirements • **Career insights and recommendations** These tools are designed to **assist** your job search preparation. They do not replace professional career counseling or recruiting services.

**Important:** Ergon Chat does NOT guarantee: • Employment or job offers • Interview invitations • Success in selection processes • Accuracy of AI-generated content • Specific outcomes from using our tools AI-generated responses, feedback, and recommendations may contain errors, inaccuracies, or outdated information. **You are solely responsible for reviewing, validating, and deciding how to use any content generated by the platform.**

Our Service uses artificial intelligence (including Google Gemini and other AI providers) to generate content, simulate interviews, and provide feedback. • AI outputs are probabilistic and may not always be accurate • AI may produce content that is generic, incomplete, or contextually inappropriate • AI cannot guarantee factual accuracy or professional advice • You should independently verify any important information • AI responses do not constitute legal, financial, medical, or professional advice By using the Service, you acknowledge these limitations and accept full responsibility for how you use AI-generated content.

**Billing Cycle:** Subscriptions are billed quarterly in advance. Prices are displayed in USD. **Payment Processing:** Payments are processed securely through Stripe. We do not store your full payment card details. **Automatic Renewal:** Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. **Cancellation:** You may cancel your subscription at any time through the billing portal. Cancellation stops future charges but does not provide a refund for the current period (except as described in our Refund Policy). **Price Changes:** We may change subscription prices with at least 30 days notice. Price changes take effect at your next renewal.

We offer a **7-day refund window** for new subscribers. If you are not satisfied, you may request a full refund within 7 days of your first payment, provided you have not made significant use of the platform. After this period, or after significant usage, refunds are not available. See our full Refund Policy for details.

You agree NOT to: • Use bots, scrapers, or automated tools to access the Service • Share your account credentials with others • Attempt to circumvent usage limits or quotas • Use the Service for any illegal or fraudulent purpose • Abuse interview simulation hours or API resources • Upload malicious content or attempt to compromise the platform • Resell, redistribute, or commercially exploit the Service • Violate any applicable laws or regulations We reserve the right to suspend or terminate accounts that violate these terms, without refund.

**Your Content:** You retain ownership of content you upload (resumes, job descriptions, etc.). By uploading, you grant us a limited license to process this content to provide the Service. **Our Content:** The platform, its design, features, AI models, and generated outputs are protected by intellectual property laws. You may not copy, modify, or distribute our proprietary content. **AI-Generated Content:** Content generated by AI through the Service is provided for your personal use. You may use it in your job applications, but we make no warranties about its suitability for any purpose.

Your privacy is important to us. Our collection and use of personal data is governed by our Privacy Policy. We use third-party services including: • **Supabase** for database and authentication • **Stripe** for payment processing • **Google/AI providers** for AI capabilities These providers have their own privacy policies and security practices.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: • The Service is provided "AS IS" without warranties of any kind • We do not warrant that the Service will be uninterrupted or error-free • We are not liable for any indirect, incidental, special, or consequential damages • Our total liability is limited to the amount you paid us in the 12 months preceding the claim • We are not responsible for decisions you make based on AI-generated content Some jurisdictions do not allow limitation of liability, so some of these limitations may not apply to you.

You agree to indemnify and hold harmless Ergon Chat and its affiliates from any claims, damages, or expenses arising from: • Your use of the Service • Your violation of these Terms • Your violation of any third-party rights • Content you upload to the platform

We may modify these Terms at any time. Material changes will be communicated via email or through the platform at least 14 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.

**By You:** You may stop using the Service and cancel your subscription at any time. **By Us:** We may suspend or terminate your access if you violate these Terms, engage in fraud, or abuse the Service. In case of termination for cause, no refund will be provided. Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

These Terms are governed by and construed in accordance with applicable law. The specific jurisdiction will be determined based on the legal entity operating the Service. Any disputes will be resolved through good-faith negotiation first, and if unsuccessful, through the competent courts of the applicable jurisdiction.
